Farmlands 'Live your Lifestyle' Promotional Terms and Conditions

Summary: Spend a minimum of $100 across the associated brands for one of the four topics promotional periods[1] and receive 1 entry into the prize draw for that topic (details outlined in the appendices). Purchases can be made from any Farmlands Store and any entry into one of the four topic prize draws also adds an entry into the final Grand Prize Draw.

General terms and conditions:

1. Entry into Farmlands Promotion or Competition (hereinafter referred to as “Promotion”) is deemed acceptance of these Terms and Conditions.

2. The details of any Promotion, including any method of entry, eligibility, prize and redemption shall be provided here or otherwise on specific advertisement for that Promotion.

3. The Promotion period shall be provided here or otherwise on specific advertisement for the Promotion.

4. The Promotion is offered by Farmlands Co-operative Society Limited of 535 Wairakei Road, Burnside, Christchurch 8053, New Zealand (“Promoter”).

5. For the purpose of the Promotion, “Farmlands Shareholder” means the primary account holder of a Farmlands Shareholder account.

6. The Promotion is open to Farmlands customers and Farmlands shareholders who are New Zealand residents, and who spend a minimum of $100 (incl. GST) on brands promoted (“Qualifying Brands”) in the “Grow”, “Improve”, “Protect”, and “Love” topic, in a single or multiple transactions (within that topic) from any Farmlands Store or Farmlands ecommerce store during the Promotion Period.  

7. To qualify for an entry into a topic’s prize draw, the $100 must be spent exclusively on participating brands within a single topic category, with a maximum of 5 entries per topic. Purchases across multiple topic categories cannot be combined to meet the $100 threshold; only full $100 spends within one topic will count toward an entry.

8. Each entry earned in a topic’s prize draw also qualifies as an entry into the Grand Prize draw. However, just like the topic entries, you must meet the $100 spending threshold within a single topic to qualify for an entry into the Grand Prize draw. A maximum of 5 entries can be earned for the Grand Prize.

9. Employees of Farmlands (Farmlands shareholders and non-shareholders) are not eligible to participate in the Promotion.

10. The Promoter reserves the right to request proof of an entrant’s eligibility if there is a doubt over his/her eligibility for the Promotion and to disqualify any entrant who tampers with the entry process or that is not in accordance with these Terms and Conditions. 

11. At all times, the eligibility to enter and/or win the Prize offered for the Promotion is subject to the entrant’s account with Farmlands being in good standing, not overdue and subject to the approval of Farmlands’ Credit and Risk Team. The Promoter at its sole discretion may deem an entry invalid on this basis and forfeit the Prize.

12. The fortnightly prize details are outlined in the appendices2: The winners for each fortnight topic will be drawn by the Promoter after the end of the topic week. The prize winner(s) will be randomly drawn from all eligible entries received.  

13. In addition to fortnightly prize draws, all eligible entries will automatically apply to the Grand Prize draw of a Honda ATV TRX420FM2 and $5,000 worth of Z fuel vouchers. This Grand Prize will be drawn by the Promoter after the end of the Promotion Period.  A maximum of 5 entries per customer or shareholder applies into the Grand Prize draw.

14. The Prize2 is subject to availability, and while stocks last for the purpose of this Promotion, and cannot be exchanged, transferred, or redeemed for cash. Any lost or stolen Prize will not be replaced or refunded. If the Prize or any part of the Prize is unavailable for any reason, the Promoter in its sole discretion reserves the right to substitute the Prize or part thereof with a prize of equal value and/or specification.

15. If applicable, the Prize-winner will be contacted by the Promoter after the end of the Promotion Period or Prize Draw Week using the contact details provided by the Shareholder for his or her Farmlands account or if Farmlands customer in the entry form. If a Prize-winner cannot be contacted with his or her provided contact details or other means, or the contact details provided on the Shareholder’s Farmlands account are incorrect, the Prize may, at the Promoter’s sole discretion be forfeited.

16. If applicable, the Prize-winner is responsible for collecting the Prizes from the Farmlands store at their own cost, within the specified time advised by the Promoter.   If the Prize Winner requests for the Prizes to be posted or couriered, there will be extra fees and charges for the postage/courier services and Farmlands takes no liability for any stolen, missing or damaged Prizes.

17. The Promoter’s decisions on all matters will be final and no correspondence will be entered into.

18. The Promoter may cancel, terminate, modify, or suspend the Promotion or these Terms and Conditions at any time and for any reason before the end of the Promotion Period and shall not be liable to any participant or Prize winner for any loss or damage incurred as a result.

19. The Promoter takes no responsibility for omission, interruption, deletion, defect, line failures of any telephone network, computer equipment, software, inability to access telecommunications network services, or any other error or malfunction in respect of the Promotion and any resulting failure to record any eligible entries.

20. Except for liability that may not by law be excluded, the Promoter shall not be liable under or in connection with these Terms and Conditions and/or this Promotion for any cost, expense, loss or damage suffered by any participant, even if such cost, expense, loss or damage was reasonably foreseeable, and whether arising from breach of contract, tort, negligence, breach of statutory duty or otherwise.

21. These Terms and Conditions are governed by New Zealand law and any dispute arising out of or in connection with them will be subject to the exclusive jurisdiction of the New Zealand courts.

22. The Prize winners consent and waive all rights (including copyright and moral rights), to the Promoter using the Prize winner’s name, likeness, image and/or voice (including photograph, film, and/or recording of the same) in any media for an unlimited period of time without remuneration for the purpose of promoting this Promotion, and promoting any products distributed and/or supplied by the Promoter.

23. Participants in the Promotion agree not to make any commercial or business use of the Promotion to resell or commercially benefit from any part or aspect of the Promotion.
