General terms and conditions:
1. By participating in the Promotion, customers agree to these Terms and Conditions.
2. The Promotion is offered by Farmlands Co-operative Society Limited of 535 Wairakei Road, Burnside, Christchurch 8053, New Zealand (“Promoter”).
3. The Promotion is open to all Farmlands customers who are New Zealand residents, and who purchase at least one Qualifying Product (products listed at the end of these Terms and Conditions in a single transaction during the Promotion Period, either purchased in store or online and receive one Gingerbread Xmas Dog Toy, while stocks last. Limited to one Gift per transaction.
4. Employees of Farmlands are not eligible to participate in the Promotion.
5. The Promoter reserves the right to request proof of an entrant’s eligibility if there is a doubt over his/her eligibility for the Promotion and to disqualify any entrant who tampers with the entry process or that is not in accordance with these Terms and Conditions.
6. For in-store purchases, the Gift will be scanned out and provided at the time of purchase. For an eligible online purchase, the Gift will be included with delivery, subject to stock being available when the order in fulfilled. If the Gift is faulty or damaged when provided, please contact your nearest Farmlands store or call 0800 200 600. Any warranty or aftercare claims will be managed in accordance with applicable law.
7. If a customer returns a Qualifying Product for a refund or exchange, the customer must also return the Gift in its original condition. If the Gift is not returned, Farmlands may deduct the stated retail value of the Gift from any refund otherwise payable, except where this would be inconsistent with the customer’s rights under applicable law. Nothing in these Terms and Conditions limits any rights or remedies that cannot lawfully be excluded.
8. The Gift is subject to availability, and while stocks last for the purpose of this Promotion, and cannot be exchanged, transferred, or redeemed for cash. In all cases the Gift is subject to stock availability (limited to 3000 units in total).
9. If the Gift or any part of the Gift is unavailable for any reason, the Promoter in its sole discretion reserves the right to substitute the Gift or part thereof with a gift of equal value and/or specification.
10. The Promoter’s decisions on all matters will be final, and no correspondence will be entered into.
11. The Promoter may amend, suspend or cancel the Promotion where circumstances beyond its reasonable control prevent the Promotion from operating as intended. Any change will not affect a customer’s entitlement to a Gift arising from a qualifying purchase completed before the change, subject to the stated stock limitation.
12. Except for liability that may not by law be excluded, the Promoter shall not be liable under or in connection with these Terms and Conditions and/or this Promotion for any cost, expense, loss or damage suffered by any participant, even if such cost, expense, loss or damage was reasonably foreseeable, and whether arising from breach of contract, tort, negligence, breach of statutory duty or otherwise.
13. These Terms and Conditions are governed by New Zealand law and any dispute arising out of or in connection with them will be subject to the exclusive jurisdiction of the New Zealand courts.
14. Participants in the Promotion agree not to make any commercial or business use of the Promotion to resell or commercially benefit from any part or aspect of the Promotion.
